Government regulators across the nation have been cracking down on children's lemonade and concession stands.

Thankfully we haven't yet seen that kind of madness in Colorado, and hopefully we won't.  If we do, however, know that The Law Office of Alexander Hornaday, LLC will stand with you to protect your rights.  We are offering FREE* representation to Coloradans who run afoul of regulatory overreach because of a child's lemonade or concession stand. The Law Office of Alexander Hornaday, LLC advises against the willful noncompliance with the law, but in the event you or your child have an encounter with regulators or government officials because of a child's lemonade stand, we are happy to help.
 

If an official tells you to close your child's lemonade stand for any reason, the more information and documentation you get at the time, the stronger your case will be.  Specifically keep in mind the following:

  • Always be respectful of any officials, follow their instructions even if you think they are wrong, and do not antagonize them.
  • Ask what is the statute or regulation that gives them the authority to shut down the stand, and what are the grounds for doing so.
  • Ask if the law or regulation specifically empowers them to shut down the stand or merely issue tickets for violations, especially a first violation.
  • Ask the officer if there are any exceptions in the rule for businesses owned and operated by minors, or businesses that earn below a certain amount (which may be referred to in the law or regulations as "de minimus"). 
  • Ask to see the law or regulation. 
  • Get the officer's name and badge number, or if not a police officer, the official's name, agency or department, and job title. 
  • If possible, record the entire interaction on video (even if just a cell phone).   
  • Do not offer the officials anything (including free lemonade) to overlook the violation.  
  • Again, always be respectful of any officials, follow their instructions even if you think they are wrong, and do not antagonize them.
*The free representation means the Firm will waive its legal fees, but potential clients should note they may be required to pay court costs, filing fees, and/or any fines imposed on them.  The Firm may decline the representation of any particular client in accordance with the Colorado Rules of Professional Conduct.  For example, the Firm may decline representation for reasons such as conflicts of interest, the ability of the Firm to provide full, competent, and vigorous representation in specific cases, and/or the resources of the Firm.
